Article 1 – Definitions

  1. Additional agreement: An agreement whereby the consumer acquires magnets and/or related products in connection with a distance contract.
  2. Cooling-off period: The period during which the consumer can exercise the right of withdrawal.
  3. Consumer: The natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  4. Day: Calendar day.
  5. Continuous contract: A distance contract concerning a series of deliveries of magnets, where the purchase obligation is spread over time.
  6. Right of withdrawal: The consumer's option to withdraw from the distance contract within the cooling-off period.
  7. Durable data carrier: Any means – including email – that allows the consumer or entrepreneur to store information for future reference.
  8. Entrepreneur: The natural or legal person who offers magnets and/or related products to consumers remotely.
  9. Distance contract: A contract concluded via an online platform, email, or other means of communication regarding the sale of magnets.
  10. Means of remote communication: A means that can be used to conclude a contract without the consumer and entrepreneur meeting physically.

Article 3 – Applicability

  • These general terms and conditions apply to every offer from the entrepreneur and every distance contract concluded between the entrepreneur and the consumer.
    The general terms and conditions are made available to the consumer before the contract is concluded.

Article 4 – The Offer

  • The offer contains a clear description of the magnets offered, including images and specifications.
    Obvious errors or mistakes in the offer are not binding on the entrepreneur.

    The offer clearly states:
  • The price, including taxes.

Any shipping costs.

The payment, delivery, and execution methods.Article 5 – The Agreement

The contract is concluded when the consumer accepts the offer and meets the stated conditions.

If the consumer accepts the offer electronically, the entrepreneur will immediately confirm receipt of the order.

Article 6 – Right of Withdrawal

The consumer has the right to terminate the purchase within 14 days of receiving the magnets without providing any reason.

Exceptions to the right of withdrawal:

Magnets that are custom-made or manufactured according to the consumer’s specifications.

Products that are damaged due to use.

Article 7 – Consumer Obligations During the Cooling-off Period

The consumer must handle the received magnets and packaging with care.

If damage occurs due to improper use, the consumer is liable for depreciation.

Article 8 – Exercising the Right of Withdrawal and Related Costs

The consumer must notify the return in writing or via email within the cooling-off period.

The consumer bears the return shipping costs unless otherwise agreed.

Returned items must be sent back in their original condition and packaging.

Article 9 – Entrepreneur’s Obligations in Case of Withdrawal

The entrepreneur confirms receipt of a return notification and processes the refund within 14 days of receiving the returned package.

Article 10 – Exclusion of the Right of Withdrawal

The entrepreneur may exclude certain products from the right of withdrawal, provided this is clearly stated in the offer, such as:

Custom-made magnets.

Used or damaged magnets.

Article 11 – Price

The prices of the offered magnets include VAT.

Any shipping costs are stated separately in the offer.

Article 12 – Delivery and Execution

The entrepreneur will process orders carefully and ship them within the specified delivery period.

If a product is out of stock, the consumer will be informed and has the right to cancel the order.

Article 13 – Payment

The consumer must make payments using the payment methods available on the website.

If payment is not received on time, the entrepreneur reserves the right not to process the order.

Article 14 – Complaints Procedure

Complaints about the execution of the contract must be submitted in a timely manner and fully described via info@ememorea.com.

The entrepreneur strives to process complaints within 14 days.

Article 15 – Additional or Deviating Provisions

Deviations from these general terms and conditions are only valid if agreed upon in writing.

Dutch law exclusively applies to contracts between the entrepreneur and the consumer.
